1. Definitions

In these Terms and Conditions, the following terms have the meanings given below:

"Nestwise", "we", "us", "our" — refers to Nestwise, a business registered and operating from 99/18 Rama IX Road, Huai Khwang, Bangkok 10310, Thailand.
"Services" — the retirement information and document support services offered by Nestwise, including Retirement Readiness Workshops, Document Organisation Support, and Records & Correspondence Companion.
"User", "you", "your" — any person who accesses our website, submits an enquiry, or books or participates in a Nestwise service.
"Agreement" — these Terms and Conditions, together with any service booking confirmation.
"Content" — all written material, checklists, summaries, and reference guides produced by Nestwise.
"Session" — any in-person or remote appointment delivered as part of a Nestwise service.

2. Acceptance of Terms

By submitting an enquiry form, making a booking, or participating in any Nestwise service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services.

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use our services.

3. Nature of Services

Nestwise provides informational, educational, and document organisation services only. Specifically:

We explain how publicly available retirement systems and documents work in plain language.
We help organise, label, and track retirement-related correspondence and records.
We do not provide financial advice, investment recommendations, tax advice, legal advice, or any service requiring a regulated licence under Thai or international law.
Nothing communicated by Nestwise — verbally, in writing, or through any document summary — constitutes regulated financial or legal advice.

If a question or requirement falls outside our informational scope, we will say so and may suggest the type of professional to consult. Any such suggestion carries no financial arrangement or referral fee.

4. Service Availability

Services are offered from our Bangkok office and are available to residents of Thailand and visitors. Sessions may be held at our premises or, where agreed in advance, at an alternative location. We operate Monday to Friday 9:00 AM – 5:30 PM and Saturday 10:00 AM – 2:00 PM, excluding Thai public holidays.

5. Booking and Confirmation

A service booking is confirmed upon receipt of a written confirmation from Nestwise. We reserve the right to decline any booking at our discretion. Confirmed bookings constitute an agreement between you and Nestwise subject to these Terms.

6. User Responsibilities

When using our services, you agree to:

Provide accurate information when making an enquiry or booking
Arrive at sessions on time and prepared, including bringing any documents described in advance
Treat Nestwise staff with respect during all interactions
Not use our services in any way that is unlawful, deceptive, or harmful to others
Not request that Nestwise provide regulated financial, legal, or professional advice

7. Payment Terms

Service prices are stated in Thai Baht (฿) and are payable before or at the time of the session unless an alternative arrangement is agreed in writing. Accepted payment methods will be confirmed at booking. Prices are inclusive of all session elements described in the relevant service description.

Rescheduling and Cancellations

You may reschedule a session with at least 48 hours' notice at no charge.
Cancellations made more than 48 hours before a session: full refund or credit to a future session.
Cancellations made fewer than 48 hours before a session: 50% of the session fee is retained.
No-shows without notice: the full session fee is retained.
Nestwise may cancel or reschedule a session due to unforeseen circumstances; in such cases a full refund or alternative appointment will be offered.

8. Confidentiality

Nestwise will not copy, photograph, retain, or share any documents you bring to a session. Personal information collected during bookings is handled as described in our Privacy Policy.

9. Intellectual Property

All Content produced by Nestwise — including session summaries, checklists, reference guides, and the Document Map — is provided for your personal, non-commercial use only. You may not reproduce, distribute, or publish Nestwise Content without prior written permission. Our website content, branding, and materials are the property of Nestwise.

10. Disclaimer

Nestwise services are provided on an informational basis. We make no representation that any particular outcome will result from using our services. We do not verify the accuracy or completeness of documents you bring to sessions — our role is to help you understand and organise them, not to audit or validate their contents.

Information shared in sessions reflects publicly available knowledge about retirement systems and document formats. It does not constitute advice about any individual's specific financial, legal, or personal circumstances.

11. Limitation of Liability

To the fullest extent permitted by Thai law, Nestwise's total liability in connection with any service or these Terms shall not exceed the total amount you paid for the specific service giving rise to the claim. Nestwise shall not be liable for any indirect, consequential, or special loss or damage arising from use of our services.

This limitation does not apply to liability for death or personal injury caused by negligence, or any liability that cannot lawfully be excluded.

12. Force Majeure

Nestwise is not liable for failure to perform any obligation where such failure results from events beyond our reasonable control, including but not limited to natural events, government actions, pandemics, or infrastructure failures.

13. Indemnification

You agree to indemnify and hold Nestwise harmless from any claims, losses, or expenses arising from your breach of these Terms, your misuse of our services, or any false or misleading information you provide to us.

14. Termination

Either party may terminate a service engagement by giving written notice. If Nestwise terminates an engagement before a session is delivered for reasons other than your breach, a full refund of fees paid for undelivered sessions will be provided. Sections 9, 10, 11, and 13 survive termination of the Agreement.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute, we encourage you to contact us first at [email protected] so we can attempt to resolve the matter informally. If informal resolution is not possible, disputes shall be subject to the jurisdiction of the competent courts in Bangkok, Thailand.

16. General Provisions

Entire agreement: These Terms, together with your booking confirmation, constitute the entire agreement between you and Nestwise in relation to the services.
Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
Waiver: Failure by Nestwise to enforce any provision does not constitute a waiver of future enforcement rights.
Assignment: You may not assign your rights under these Terms without our written consent.

17. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of our services after a change constitutes acceptance of the updated Terms.
